This page contains the Terms and Conditions governing your use of the TheLogoDoctor.com Website and its services. Please read this page carefully. The following Terms and Conditions form a binding Agreement between you and TheLogoDoctor.com. Your use of the TheLogoDoctor.com Website indicates your acceptance of these Terms and Conditions.

The Logo Doctor agrees to award all rights associated with ownership and usage of materials developed by The Logo Doctor to the customer upon completion of the project, receipt of full payment and completed transfer certificate. Until such time The Logo Doctor retains and reserves all rights to any content created by The Logo Doctor as set forth by the Copyright Laws of the United States of America (Title 17 U.S.C., et seq., and the Digital Copyright Act).

OWNERSHIP/COPYRIGHTS

Ownership (copyright and title) of the final artwork becomes the property of the Client, having unlimited, indefinite, and royalty-free use of the image upon project completion, receipt of full payment and completed transfer certificate. The Logo Doctor retains rights to display the artwork in portfolio and advertising materials. All concepts, comprehensives, or other preliminary materials, which are not selected by the Client or are not included into the final delivery, remain the full property of The Logo Doctor.

INITIAL CONCEPT DELIVERY

1. All interaction occurs over the Internet.

2. Order confirmation will be sent to you by email confirming the immediate start of the project within one business day. The order will be confirmed only after receipt of completed Order Form and payment confirmation.

3. Someone will collaborate with you on your job, depending on the work needed.

5. Guaranteed two day delivery may be available for an additional fee. Email for details.

REVISIONS

1. All interaction occurs over the Internet.

2. Revision requests shall be submitted via email. Revision cycles consist of 1-6 additional compositions that incorporate specific changes requested by the client. The purpose of the revision process is to create responses that move forward in a specific direction from a single design composition as chosen by the client. Client’s requests shall be modifications of the chosen composition only. Revision requests that depart from the current composition or require major graphical changes, will be honored and completed in the same timely manner, however; The Logo Doctor reserves the right to charge $50 for each such Revision. No revision work, which requires payment, will be started without authorization from Client.

3. If the Client wishes to pursue more or other work from the initial concepts presented, additional payment must be made.

4. Revision or extra work cycles take a minimum of 5 business days to complete, depending on the complexity of your requested changes and schedules.

5. Client shall have 30 days to respond to work/concepts/revisions submitted to Client for review. If after 30 days the Client has failed to so respond, The Logo Doctor will assume the Project complete and the Project shall be deemed to be complete.

* Additinal changes outside of original quote of project, to the work in progress, will result in additional fees that must be paid in full before the project can continue.

FINAL DELIVERIES

1. Upon completion of your logo design project, your final files will be made available for you to via email, so you can begin using them right away. You will receive ONE logo in each of the following formats: .AI, .EPS, .JPEG, with the option of other file formats like, .PDF (resolution independent) .JPEG, 72 DPI .GIF, and .TIF files.

2. Your files will remain available for thirty days. As we do not maintain art files indefinitely, you must request your files within thirty days of initial order!

*The Logo Doctor assumes no liability to customers for any lost business or other damages, real or constructive, whatsoever. Buyer assumes full risk of possible delays.

*Buyer assumes full responsibility of ensuring the compatibility of the provided files with their own system. While many help and FAQ files are provided, The Logo Doctor assumes no liability to the customer for his own level of technological comprehension, nor for customers lack of access to proper hardware or software for viewing, printing or editing the provided files.

ADDITIONAL WORK

Should Client require additional artwork beyond the scope of the initial order (either concurrently with the project or at a later date), the Client will be offered a price list for the other items. Additional work will be done after prepaying add-on services in full.

Please note that detailed illustrations are beyond the scope of logo design and are not included in the price. Detailed illustrations do not work well as part of a logo and we highly recommend against their use! Still, you may choose to include a detailed illustration in your design, which we will be happy to provide for an additional fee.

GUARANTEE & REFUND POLICY

The Logo Doctor is committed to designing for you work that you will be satisfied with. For this reason, at any time before requesting your project, you may request to have all work stopped and your money refunded (less a minimum $50 service fee for all refunds).

This refund policy is void if any of the following conditions apply: :If you have requested revisions or changes; If you have purchased a redraw or rework of your project; If we do not hear back from you for more than 30 days; If the company we are working for closes, changes their name or their activity; If the project was closed for reasons unrelated to our design.

Once you have requested revisions or changes, you will no longer be eligible for a refund. Instead, we offer a 100% Satisfaction Guarantee of your logo design until you approve of your final design.

*The Logo Doctor is not responsible for technological delays beyond our immediate control. If your spamblocker blocks our emails from reaching you, or if you do not provide a valid email address where you can be reached, The Logo Doctor reserves the right to conclude your project at any time, with or without a refund, which will be at The Logo Doctor sole discretion.

PRINTED MATERIALS

The Logo Doctor offers no guarantee of "match-print" or "match-product" color fidelity and cannot prevent slight color drift throughout an order. The Logo Doctor cannot calibrate customers computer monitor and therefore does not guarantee color will match the preview as it appears on customers monitor.

The Logo Doctor does not check any final submission for spelling, grammar, or any other errors. It is the sole responsibility of the customer to ensure that all materials given their final approval correctly and comply with any and all applicable laws.

REGARDING TRADEMARKS AND SERVICE MARKS

The Logo Doctor expects the Client to perform researching on their company name to be sure the name is not already in use and securing a trademark or service mark to protect the Client’s legal rights to any name or image. The Logo Doctor is not and will not be held responsible for any legal action that may result from improper due diligence on the availability of a company name or image.

VIOLATIONS OF TERMS AND CONDITIONS

Your violation of these terms and conditions, including attempted chargeback when ineligible for a refund, will be considered attempted fraud and breach of contract, and will immediately conclude your project. The Logo Doctor will not, under any circumstance, resume work with a client who has breached our contract and attempted to obtain our services fraudulently.

The Logo Doctor reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including the right to block access from a particular Internet address to the Site. You agree to indemnify, defend and hold harmless The Logo Doctor from any liability, loss, claim and expense, including attorney’s fess related to your violation of these terms and conditions or your use of the services and information provided at the site.
